Neeraj Dubey is a principal senior associate and a commercial lawyer with over 7 years of legal experience in India. From the start of his legal practice, he has been involved in diverse practice areas encompassing vast gamut of commercial law, intellectual property, taxation and technology including media and telecommunications law. His practice consists of routinely counseling the firm’s manufacturing and service industry clients on a vast range of compliance in all elements of commerce and business including labor & employment, environment and taxation. Neeraj’s industry focus spreads across automobile, banking, food, pharmaceuticals, waste management, chemicals, energy and TMT. He also acts for clients in representing heavy industry including corporations engaged in manufacturing a diverse range of products which, inevitably, involves a focus on environment and safety management.
Over the years, Neeraj has advised clients on entry strategies in India including choosing appropriate legal structures, conducted and supervised legal audits and counseled on employment, environment, IPR and technology law issues in due diligences. Neeraj has extensive experience in assessing the impact of environment regulations and conducting human safety audit in companies using hazardous chemicals or generating hazardous wastes. He has drafted and revised health and safety policies of companies and advised them in contracts containing provisions pertaining to health, safety and environmental matters. By means of off-site and on-site audits and due diligence, he has assisted in identifying and quantifying environmental liabilities and risks in connection with air, water, noise and solid, hazardous and toxic waste standards. He has advised clients and assisted them in completing the health, safety and environment related registrations, compliances and successfully handled issues pertaining to default and violations. He has been managing routine business environmental liabilities for several companies. He has played a pivotal role in advising a waste management company in energy efficiency, health safety of its labor and IP related matters by conducting investigation of current and former manufacturing facilities, and for the subsequent removal or remedial actions to address unacceptable risks from releases at the facility.
During the course of a secondment with a major pharmaceutical company, Neeraj worked closely with the business teams and got invaluable insights on business challenges while handling their legal issues related to licensing, pricing, competition, distribution, supply, service and clinical trial agreements. He was also involved in drafting policy documents for creation of national franchise network of medical services and health safety measures in social welfare projects promoted by a multinational company and another by a PSU in India.
While drafting contracts he has been involved in advising clients on a wide range of issues emanating from technology agreements dealing with use, supply, licensing, and maintenance of computer services and/or facilities, software licensing, technical services, web-hosting agreements, user/subscriber agreements, content license agreements, and other related services. He has also worked on web designing contracts, advised on web content including a website of a government department. The depth of Neeraj’s experience includes advising clients on a host of tax matters including transfer pricing, company tax, expatriate tax issues, as well as withholding tax and other aspects of both direct and indirect taxes particularly in the context of trade matters.
Before joining PSA, Neeraj worked with a Delhi-based firm with a primary focus on IPR, information technology and food laws. Apart from assisting senior counsels in litigation matters and representing clients in different judicial forums, he worked closely with clients on general corporate and related regulatory issues. He was also involved in arbitration proceedings related to a major golf ball producing company of Asia. He has also litigated IP infringement & passing-off action(s). Such litigation experience has provided a strong foundation as well as understanding of litigious issues that arise in contracts and how these need to be handled while drafting.
Neeraj is a multi-lingual and can communicate in English, Hindi and several regional languages with ease. He has represented PSA at various national seminars in India and has been a speaker at iTechlaw’s Asian conference in 2010 on the subject “Technology Mediated Dispute Resolution - A new paradigm for ADR.” He has also moderated a session on “Life Sciences and Information Technology Cross-Over” at iTechlaw’s Asian conference 2011. He runs an NGO named SPRIHA that works towards empathy building among children and promoting human aspirations in general.

• Assisted extensively in setting up of cyber laws consulting centre and worked as a legal researcher for the book “Cyber laws in the Information Technology age” published by Lexis Nexis Butterworths.
